PURCHASE AND USE AGREEMENT

YOUR PURCHASE AND USE OF MERCHANDISE IS SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS ("AGREEMENT"). BY CLICKING THE "I AGREE" DURING YOUR ORDER, YOU REPRESENT THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, AGREE TO ENTER INTO THIS AGREEMENT ELECTRONICALLY, AND AGREE TO BE BOUND BY THIS AGREEMENT, WHICH HAS THE SAME LEGAL EFFECT AS A SIGNED, PRINTED DOCUMENT.

1. This Agreement is between you ("Purchaser") and KTB ENTERTAINMENT INC. d/b/a KITTYSTOYBOX.COM ("KTB"), which exclusively governs: (i) your purchase through this website ("Order") of Merchandise; and (ii) terms of usage.

2. All prices, fees and availability are subject to change without notice. KTB reserves the right, in its sole discretion, to cancel or refuse any Order for any reason.

3. RETURN POLICY. Broken or Defective Products: All of our products are guaranteed against breakage for 30 days. If your item breaks or is defective, we will gladly send a replacement. Just call us for a Return Merchandise Authorization (RMA) number and instructions on returning your item.

Returns or Exchanges: If you are dissatisfied with an item, many unopened items that are still sealed in their original packaging may be returned for an exchange or refund within 15 days of receipt. We do not accept non-defective exchanges on items that have been opened.

Please note that pre-authorization is required for all returns and exchanges. For a Return Merchandise Authorization (RMA) number, please call us at (954) 288-8691.

Shipping Charges: We do not refund shipping expenses.

5. KTB may limit the number of Merchandise items available to Purchaser. By entering into this Agreement, you are representing that you are not a bulk purchaser or whole seller and that the items purchased will not be resold or otherwise transferred in violation of applicable laws and regulations. It is solely Purchaser's responsibility to comply with applicable laws that relate to the resale or transfer of the item.

8. DISCLAIMER OF WARRANTIES. THE MERCHANDISE IS PROVIDED "AS IS" AND KTB EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

9. LIMITATION OF LIABILITY AND INDEMNIFICATION. YOU AGREE THAT YOUR PURCHASE AND USE OF THE MERCHANDISE IS AT YOUR OWN RISK; AND YOU ASSUME ALL RISKS INCIDENTAL TO THE USE OF THIS PRODUCT. KTB SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES FOR ANY MATTER ARISING FROM OR RELATING TO THIS AGREEMENT, THE PURCHASE AND/OR USE OF THE MERCHANDISE. YOU AGREE TO DEFEND, INDEMNIFY AND HOLD KTB, ITS AGENTS, MANAGEMENT, AND EMPLOYEES, AND PERFORMERS, HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, SUITS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEYS' FEES, RESULTING DIRECTLY OR INDIRECTLY FROM YOUR PURCHASE AND/OR USE OF MERCHANDISE.

10. Each party represents and warrants that: (i) such party has full right and authority to enter into this Agreement; (ii) this Agreement constitutes a legal, valid, and binding obligation of such party; and (iii) this Agreement shall have the same legal effect and force as a written and signed document.

11. No waiver of any breach or series of breaches or defaults and no failure to exercise any right hereunder shall not be considered a waiver of any subsequent breach of the same or any other term or condition hereof.

12. All provisions of this Agreement shall be severable. The invalidity of any provision shall not affect the validity of the remaining provisions. In the event of the invalidity of any provisions, this Agreement shall be interpreted and enforced as if such provisions were not contained herein.

13. This Agreement and any dispute hereunder shall be governed by the laws of the State of Oregon and any action concerning or arising from this Agreement shall be brought in the State of Oregon .

15. KTB's Terms of Use and Privacy Policy, which may be amended from time to time, shall apply to all the transaction(s) pertaining to your Order and use of KTB's website. The current version of KTB's Terms of Use and Privacy Policy can be found at: www.KTBofficetickets.com/privacy.html.
